1.1 These terms govern your access to and use of the AJT Jewellery website and all related sites, services, and offers, including the purchase of goods and services.
1.2 By using the website, placing an order, or engaging with us online you agree to be bound by these terms. If you do not agree, you must not use the website.
1.3 These terms operate together with our Privacy Policy, Returns and Refund Policy, and Shipping Policy. If there is any inconsistency, these terms prevail to the extent of the inconsistency.
In these terms:
ACL means the Australian Consumer Law in Schedule 2 of the Competition and Consumer Act 2010 Cth.
Business Day means a day banks are open for business in Melbourne, Victoria, excluding Saturdays, Sundays, and public holidays.
Intellectual Property Rights means all intellectual property rights including copyright, trade marks, designs, patents, moral rights, confidential information, and all similar rights anywhere in the world, whether registered or unregistered.
Website means ajtofficial.com and any related AJT Jewellery sites, pages, and services.
3.1 You must be at least eighteen years old and have legal capacity to enter into a binding contract.
3.2 You are responsible for maintaining the confidentiality of any account credentials and all activity on your account.
4.1 All prices are shown in Australian dollars unless stated otherwise. Prices may change without notice.
4.2 Metal and gemstone markets are volatile. Quotes and invoices reflect material prices at the time they are issued. We may adjust quotes if material prices materially change prior to payment.
4.3 Full payment is required upfront for all orders before design work, production, or procurement of materials will commence.
4.4 An order is accepted only when we issue written confirmation. We may decline or cancel any order at our discretion, in which case we will refund amounts you have paid for any unfulfilled part of the order.
4.5 If you provide incorrect or incomplete details including shipping address or ring size, you are responsible for any resulting costs or delays.
5.1 All jewellery is custom made to order. Design work, renders, and sample images are indicative only. Natural variations in hand finishing, patina, stone characteristics, and casting are normal and not defects.
5.2 All custom and made to order pieces are final sale. There are no refunds or exchanges for change of mind, personal circumstances, or delays outside our reasonable control.
5.3 Ring size is provided by you. If the size is incorrect, a new ring must be made at your full cost including shipping. Resizing may be limited or not possible on detailed pieces.
6.1 Discount codes must be entered at checkout. If a code is not entered or is entered incorrectly, you are not entitled to any refund or credit of the difference.
6.2 Discounts do not apply to special custom orders, upgrades, or additional work such as gemstones or engraving unless expressly stated.
6.3 We may withdraw or change any promotion at any time.
7.1 Production lead times are estimates only. Standard custom orders are usually five to twelve weeks. One of a kind or complex designs are usually five to fifteen weeks. Lead times depend on design approvals, production load, and material availability.
7.2 We ship with express or international couriers and provide tracking. Title and risk in the goods pass to you when we dispatch the order to the carrier.
7.3 Delivery time frames depend on destination and carrier operations. We are not responsible for carrier delays, customs processing, or events outside our reasonable control.
7.4 International orders may attract duties, taxes, and import fees which are your responsibility as the importer of record.
8.1 Our Returns and Refund Policy forms part of these terms.
8.2 We warrant our merchandise to be free from manufacturing defects. If you believe your item is defective, you must contact us within seven days of receipt with proof of purchase and clear evidence of the issue. We will inspect and at our discretion repair or remake the item.
8.3 Shipping and insurance costs for any return to us are payable by you unless we sent an incorrect item or confirm a manufacturing defect.
8.4 Nothing in these terms limits your rights under the ACL.
9.1 Our goods come with guarantees that cannot be excluded under the ACL. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
9.2 Subject to the ACL and to the maximum extent permitted by law, our liability is limited at our option to repair, replacement, resupply, or refund of the relevant goods or services.
10.1 We use reasonable care to display products accurately, however colours, finishes, and proportions may vary on different screens and due to the nature of handcrafted work. Photographs and renders are illustrative.
10.2 Typographical errors may occur and are subject to correction.
11.1 Any comments, feedback, suggestions, photos, or other materials you submit to us are non confidential and become our property. You grant us a perpetual, royalty free, worldwide licence to use, reproduce, modify, publish, and display such materials in connection with our business.
11.2 You warrant you own or control the rights to your submissions and that they do not infringe any third party rights.
12.1 We own or license all Intellectual Property Rights in the website, our designs, names, logos, images, text, and content.
12.2 You must not use our intellectual property except as permitted by law or with our prior written consent. We do not replicate other makers. We will be inspired by your references to create an original AJT Jewellery design for you.
You must not use the website to engage in any unlawful, misleading, infringing, or harmful activity including hacking, scraping, data mining, or introducing malware. You must not attempt to interfere with the security or performance of the website.
The website may integrate third party services such as payment gateways, couriers, analytics, and currency conversion tools. Those services are operated by third parties and are subject to their terms and privacy policies. We are not responsible for third party acts or omissions.
Our collection and use of personal information is described in our Privacy Policy. By using the website you consent to that policy.
16.1 To the maximum extent permitted by law and subject to the ACL, the website is provided as is and as available. We do not warrant it will be error free or uninterrupted.
16.2 To the maximum extent permitted by law and subject to the ACL, we exclude all liability for indirect or consequential loss, loss of profit, loss of opportunity, or loss of data.
16.3 You indemnify us and hold us harmless from and against all claims, liabilities, losses, damages, and costs arising out of your breach of these terms, your misuse of the website or products, or your infringement of any third party rights.
We are not liable for any delay or failure to perform caused by events beyond our reasonable control including acts of God, natural disasters, war, strikes, pandemic events, failure of suppliers, or carrier disruptions.
We may update these terms at any time. The updated terms take effect when posted on the website. Your continued use of the website after changes are posted means you accept the updated terms.
We may suspend or terminate your access to the website at any time without notice. Clauses which by their nature should survive termination do so, including those relating to intellectual property, disclaimers, liability, and indemnities.
Links on the website are for convenience only. We are not responsible for the content or privacy practices of linked sites and do not endorse them.
21.1 These terms are governed by the laws of Victoria, Australia. You submit to the exclusive jurisdiction of the courts of Victoria and the Federal Court of Australia seated in Victoria.
21.2 Before starting court proceedings, the parties must use good faith efforts to resolve any dispute by negotiation. This does not prevent seeking urgent injunctive relief.
22.1 If any provision is invalid or unenforceable, it will be read down or severed and the remaining provisions will continue in full force.
22.2 A waiver must be in writing and signed. A failure to enforce is not a waiver.
22.3 These terms constitute the entire agreement between you and us regarding the website and our online sales.
